  • Your content (excluding credit card info) may be transferred unencrypted over various networks and adapted to technical requirements. Credit card info is always encrypted during transfer.

  • Headings are for convenience only and do not limit these Terms.

Section 3 — Accuracy, Completeness & Timeliness of Information

We are not responsible if information on this site is not accurate, complete, or current. Content is for general information and should not be the sole basis for decisions without consulting primary, more accurate, or more timely sources. Historical information is provided for reference only. We may modify site contents at any time but have no obligation to update. You agree it’s your responsibility to monitor changes.

Section 4 — Modifications to the Service & Pricing

  • Prices are subject to change without notice.

  • We may modify or discontinue the Service (or any part/content) at any time without notice.

  • We are not liable to you or third parties for modifications, price changes, suspensions, or discontinuances of the Service.

Section 5 — Products & Services (If Applicable)

  • Certain products/services may be available exclusively online and in limited quantities; returns/exchanges follow our Return Policy.

  • We attempt to display product colors/images accurately, but cannot guarantee your monitor’s display.

  • We may limit sales to any person, region, or jurisdiction (case-by-case).

  • We may limit quantities and may change descriptions/pricing without notice.

  • We may discontinue products at any time.

  • We do not warrant that products/services/information will meet expectations or that Service errors will be corrected.

  • Dosing information is educational only and not instructional.

Warning: TheSOMDExperience products are not intended for use by persons under 21/18 years of age. Consult a physician before using any Products if you have any medical condition (including but not limited to strokes, high blood pressure, heart, liver, kidney, or thyroid disease, diabetes, anemia, depression, anxiety, psychiatric conditions), family history of these conditions, or if taking any prescription/OTC/other medications.

Section 6 — Accuracy of Billing & Account Information

We may refuse any order and may limit/cancel quantities per person, household, or order (including those using the same account, card, billing/shipping address). If we change or cancel an order, we may notify you via the contact details provided at purchase. We may limit/prohibit orders that, in our judgment, appear to be placed by dealers/resellers/distributors.

You agree to provide current, complete, and accurate purchase and account information, and promptly update your details (email, card numbers, expiration dates) so we can complete transactions and contact you.

Section 7 — Optional Tools

We may provide access to third-party tools “as is” and “as available,” without warranties or endorsements. We are not liable for your use of optional tools. Use them at your own risk and ensure you agree to third-party terms. New services/features introduced later are also subject to these Terms.

Third-party materials/links may appear on our site. We are not responsible for examining or evaluating content/accuracy and assume no liability for third-party websites, materials, products, or services. Review third-party policies before transactions. Direct complaints/claims to the third party.

Section 9 — User Comments, Feedback & Submissions

If you submit ideas, suggestions, proposals, plans, reviews, or other materials (“comments”), you agree we may edit, copy, publish, distribute, translate, and use them in any medium without restriction and without obligation to:

We may (but are not obligated to) monitor, edit, or remove content we deem unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, medical claims, or otherwise objectionable or violative of rights/Terms. You agree your comments will not infringe third-party rights or contain unlawful/abusive/obscene material or malware. Do not use false emails or mislead origins. You are solely responsible for your comments and their accuracy.

Service is not for individuals under 21. We do not knowingly collect data from anyone under 21. If you believe a minor provided data, contact us; we will remove it where required. If consent is required by your country, we may require parental consent.

We are not responsible for third-party sites’ content/privacy/practices. Review each site’s policy.

Section 11 — Errors, Inaccuracies & Omissions

We may correct errors (product descriptions, pricing, promotions, offers, shipping charges, transit times, availability) and update or cancel orders if information is inaccurate—at any time without prior notice (including after order submission). We are not obligated to update/clarify information except as required by law. No update/refresh date should be taken to indicate all information is modified or current.

You may not use the site/content:

Section 13 — Disclaimer of Warranties; Limitation of Liability

We do not guarantee uninterrupted, timely, secure, or error-free service, nor warrant results. We may remove or cancel the service at any time without notice. You agree use is at your sole risk. The Service and products are provided “as is” and “as available”, without warranties (express or implied), including merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall TheSOMDExperience (including directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, licensors) be liable for any injury, loss, claim, or any direct/indirect/incidental/punitive/special/consequential damages (including lost profits/revenue/savings, data loss, replacement costs), whether in contract, tort (including negligence), strict liability, or otherwise, arising from use of the Service/products, or for any other claim related to use of the Service/product, including errors/omissions or any loss/damage incurred through content or products made available via the Service—even if advised of the possibility. Some jurisdictions do not allow such limitations; where prohibited, liability is limited to the maximum extent permitted by law.

Section 14 — Indemnification

You agree to indemnify, defend, and hold harmless TheSOMDExperience and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim/demand (including reasonable attorneys’ fees) arising from your breach of these Terms (or referenced documents) or violation of any law or third-party rights.

Section 15 — Severability

If any provision is determined unlawful, void, or unenforceable, that portion shall be severed to the fullest extent permitted, and the remainder remains valid and enforceable.

Section 16 — Termination

Obligations/liabilities incurred prior to termination survive termination. These Terms are effective unless terminated by you or us. You may terminate at any time by notifying us or ceasing site use. If we suspect a breach, we may terminate without notice. You remain liable for all amounts due up to/including the termination date, and we may deny access to Services.

Section 17 — Entire Agreement

Failure to exercise/enforce any right or provision is not a waiver. These Terms and posted policies/rules constitute the entire agreement between you and us and supersede prior agreements/communications (oral or written). Ambiguities are not construed against the drafting party.

Section 18 — Governing Law

These Terms and any separate agreements under which we provide Services are governed by and construed in accordance with the laws of Saint Mary’s County, Maryland.

Section 21 — Order Cancellations

  • In general, orders cannot be canceled, and cancellations are not guaranteed. We will try to accommodate but cannot guarantee we will see or act on your request before shipment/processing. Order cancellation only applies before shipment/processing starts.

  • This includes address-change requests. If a package is not delivered due to an inaccurate address you provided, TheSOMDExperience is not responsible for replacement/refund/credit.

  • If we cannot cancel your order, you may return unopened product in perfect condition at your expense to receive a refund. If shipped to a wrong address you entered, you must retrieve and return unopened product before a refund. See Refund/Return Policy for details.

  • We may cancel any hemp order at any time for any reason.

Section 22 — Shipping

  • We currently ship within the United States only. Retail orders typically ship in 1–2 business days (may be longer).

  • Delta-8 THC does NOT ship to: Alaska, Arizona, Colorado, Delaware, Idaho, Iowa, Massachusetts, Montana, Nevada, North Dakota, New York, Oregon, Rhode Island, Utah, Vermont, or any jurisdiction where Delta-8/Delta-10/HHC is banned. States may change at any time.

  • Carriers: USPS (First Class, Priority, Priority Express), Rocketship (vape orders), UPS Hemp Program. Typical transit: +2–4 days (contiguous US). Times not guaranteed.

  • USPS/UPS/Rocketship will not deliver to Military Bases, Police Stations, or Schools (except colleges if over 21). Orders to these locations may be held; purchasing may be banned at our discretion.

  • Once a package leaves our facility or is in the carrier’s possession, TheSOMDExperience is no longer liable for status/location.

  • Attempts to cancel/chargeback after placing or shipping an order may be treated as attempted fraud; we may bar future purchases and may share info indicating high fraud risk.

  • Customer service emails are answered as quickly as possible, but responses are not guaranteed; there is no right of privacy to communications you send us.

  • Address Verification: if your address cannot be confirmed, we will contact you. Lack of response within 48 hours of final attempt may result in cancellation/refund. We may also verify additional information on higher-value orders under the same 48-hour rule.

  • Current processing: 1–7 business days (may be longer during holidays, trade shows/expos, or illness). Most orders ship within 48 hours.

  • USPS drop-offs: Mon/Wed/Thu (no Friday or holiday/weekend drop-offs).

  • Wholesale processing: 2–14 business days (may vary).

  • Local Home Delivery (Maryland only): 4–12 hrs, same-day eligible, $7.99

  • Local Home Delivery Rushed (Maryland only): 1–3 hrs, same-day eligible, +$4.99

  • Local Store Pickup (Maryland only): ready in 2–12 hrs, same-day eligible, no fee

  • USPS Hemp Whitelist (First Class, Priority, Priority Express) — No vape via USPS (PACT Act)

  • UPS Hemp Program (Pending)

  • Rocketship (Coming Soon) — PACT-compliant consumer vape shipping

(C) Delivery Days (Postal)

  • USPS: First Class, Priority, Priority Express

  • UPS: Ground, 3-Day, 2-Day, Next-Day

  • No vape via USPS; vape ships via Rocketship.

(D) Delta-8/HHC Shipping Restrictions

  • No shipping to: Alaska, Arizona, Colorado, Connecticut, Delaware, Idaho, Iowa, Louisiana, Massachusetts, Michigan, Minnesota, Montana, Nevada, New York, North Dakota, Oregon, Rhode Island, Utah, Washington, West Virginia, Vermont, or any jurisdiction banning Delta-8/Delta-10/HHC. Subject to change.

(E) THCA Shipping Restrictions

  • No shipping to: Arizona, Hawaii, Idaho, Minnesota, Louisiana, Oregon, Rhode Island, Utah, Vermont.

(F) How Orders Are Shipped (Packaging Steps)

  1. Heat-sealed inside eco-friendly kraft mylar bag (no window/discreet)

  2. Vacuum-sealed (some double-sealed)

  3. Hemp letter inserted; each pack receives Integra Boost 62% humidity pack

  4. Packed in compostable/eco-friendly kraft bubble mailer

  5. Label created; tracking emailed

  6. Delivered to carrier and begins transit

(G) Shipping Delays
May occur due to holidays, illness (incl. COVID-19), or carrier issues.

(H) Shipping Insurance
Available for an additional charge.

(I) Signature Required / Age Verification

  • Vape orders shipped via Rocketship are subject to AgeVerify checks and may require ID verification/adult signature. Additional compliance fees may apply.

(J) Personal Orders

  • Processing: 1–5 days (may vary around holidays). We may cancel/refund items illegal in your state.

  • Free First Class over $100; Free Priority over $250. Upgrades available.

  • Vapor products (cartridges, disposables) must ship via Rocketship and may incur fees/taxes. No vape via USPS (PACT Act).

(K) Wholesale Orders

  • Processing: typically 1–7 days (may vary by quantity). If an item is unavailable, we may offer alternatives to avoid delay.

  • Wholesale B2B: free USPS Priority or Priority Express depending on order size.

    • $250+: Free Priority

    • $800+: Free Priority Express (1-Day)

  • Upgrades to UPS/other providers available at additional cost.

Section 23 — SMS & MMS Marketing Material

We may email you about your order (tracking, invoices, questions, receipts) and may contact you if a product is out of stock or for order questions. By shopping and placing an order, you agree to these communications.

Section 24 — Payment Processing

These Terms apply to all transactions. We currently accept Credit/Debit, Sezzle, Bitcoin, Cash App, and Zelle.

  • Card payments may incur a 4% surcharge through our processor.

Section 25 — Excise Vape Taxes

  • Maryland: 12% Retail; 60% Retail if < 5 mL

  • California: 61.74% Wholesale; 12.5% Retail

  • Washington, DC: 80% of Wholesale

Section 26 — Points, Rewards, Signup Bonus & Referrals

  • $20 spent = 1 point; 1 point = $1

  • New accounts start with 5 points ($5) after signup/verification

  • Referrals: 10 points ($10) each; stackable

(A) Your Order Cancellation Rights

Please refer to our Order Cancellation Policy. Applies only to pre-ship/pre-processing orders.

(B) Conditions for Returns/Refunds/Exchanges

Goods are eligible for return if:

  • Received within the last 7 days

  • In original packaging and unopened

  • Unopened or arrive damaged (contact us immediately upon inspection)

  • Wrong item received (must be returned immediately for evaluation/correction)

Non-returnable Goods include (examples):

  • Custom/personalized items

  • Goods not suitable for return due to nature (beauty/care products), items that deteriorate rapidly or are past expiry (food, flower, concentrates, plants)

  • Unsealed items not suitable for return for health/hygiene reasons

  • Goods inseparably mixed after delivery

  • Hazardous/flammable materials or gases

We may refuse returns not meeting conditions, at our sole discretion. Some items may be eligible for store credit instead of refund (our discretion).
Sale items are not refundable (unless prohibited by law).

(C) Returning Goods

You are responsible for the cost and risk of returns. Ship to:

Use insured/trackable mail. We cannot issue refunds without receipt or proof of delivery.

(D) Gifts

  • If marked as a gift and shipped directly to you: you’ll receive store credit once returned product is received.

  • If not marked as a gift or shipped to the giver: refund/store credit goes to the gift giver.
